Who Keeps the Family Home in a Divorce?

Nebraska Is an Equitable Distribution State

Property isn’t split 50/50 in a Nebraska divorce. Instead, the court aims for what’s fair based on each spouse’s situation. That includes factors like income, contributions to the marriage, and who has custody of the kids. The court focuses on what is fair, not necessarily what is equal, when deciding who keeps the house.

You Must Qualify to Keep the House

Wanting the house isn’t enough—you need to prove you can refinance the mortgage in your name alone. Your ability to qualify can depend on factors like income, child support, and alimony. At Nebraska Legal Group, we begin this process early to give you the strongest chance of achieving a favorable result.

Equity Must Be Divided

If one spouse keeps the house, the equity must still be split fairly. This is usually done through a cash-out refinance or by awarding other assets (like retirement funds) to the other spouse. The home's value must be determined, either by mutual agreement or through a court decision.

What Our Clients Have to Say

10/10 would recommend NLG, especially Hannah Sommers. Hannah was friendly, extremely knowledgeable, and made the process extremely easy. She worked quickly for my needs to meet a short deadline. I cannot recommend her enough. Very satisfied!

I had the privilege of working with Lindsay Belmont, during the modification of my parenting agreement as part of my divorce. From the very beginning, she demonstrated exceptional professionalism, expertise, and compassion during what was an emotional and challenging process for me. Lindsay, took the time to truly understand my situation and priorities as a parent. She provided clear guidance every step of the way, explained my options thoroughly, and ensured I felt supported and informed throughout the process. Communication was always timely, and I never felt rushed or left in the dark about any developments. Thanks to Lindsay’s dedication and strong advocacy, we were able to reach an agreement that best supports my children’s needs and future. I am incredibly grateful for the care, knowledge, and professionalism she brought to my case. I highly recommend Lindsay Belmont, to anyone seeking legal help with divorce or parenting agreements. She not only delivers outstanding results but also provides the empathy and understanding that makes a difficult experience much easier to navigate.

I can't say enough good things about Nick Faletti. From the very first consultation, I felt like I was in capable hands. He took the time to really listen to my situation, explain all my options in a way I could understand, and kept me informed every step of the way. What really stood out was his dedication, kindness, and genuine care. I've worked with him twice now, and both times he fought hard for me, and I always felt like he had my best interests at heart. I'm incredibly grateful for his help and would highly recommend him to anyone needing legal assistance.
