Nebraska Is an Equitable Distribution State

Property isn’t split 50/50 in a Nebraska divorce. Instead, the court aims for what’s fair based on each spouse’s situation. That includes factors like income, contributions to the marriage, and who has custody of the kids. The court focuses on what is fair, not necessarily what is equal, when deciding who keeps the house.

You Must Qualify to Keep the House

Wanting the house isn’t enough—you need to prove you can refinance the mortgage in your name alone. Your ability to qualify can depend on factors like income, child support, and alimony. Equity Must Be Divided

If one spouse keeps the house, the equity must still be split fairly. This is usually done through a cash-out refinance or by awarding other assets (like retirement funds) to the other spouse. The home's value must be determined, either by mutual agreement or through a court decision.

Augustine Osuala and his team were fantastic. They were able to obtain what I was seeking in my custody case for my child. They did this while answering every question I had when I needed clarification and responded within a reasonable time. The front office was just as helpful whenever I needed to stop in for payments. Appreciative of the fact that when Augustine stated at the beginning that they don't nickel and dime you for every email/call/correspondence, they meant it. Augustine would delegate his paralegals to maintain portions of the case that they were able to work on which cut costs on my end while still getting a quality service. Going through a divorce is tough enough. Adam Little and Kimberly Devlin made it much easier. I asked Adam on our first meeting, “I need you to stand up for me when I can’t. Can you do that for me?” Not only did he say yes, but he and Kim did it several times throughout the process. I loved that they explained things step by step because that’s how I learn. They ALWAYS explained to me what my expectations should be and taught me to be patient through the entire ordeal. They truly are a great duo and I feel blessed to have had them to help me during a very emotional time. If I could give more than 5 stars, I would! Thank you BOTH for being so professional and kind!
